The purpose of this security is to reimburse members if the studio fails to meet its contractual obligations to its members. The law authorizes the department to collect registration fees; penalty fees are imposed on studios that do not register or post security.

Who needs a health spa bond?

In the State of Utah, health spa are required to obtain a surety bond to be in compliance with the Utah Administrative Code of the Utah Statutes. The surety required by Section 13-23-5(2) shall be provided to the Division not less than thirty (30) days in advance of any advanced sales by any health spa. Annual renewals of such Bonds, Irrevocable Letters of Credit, or Certificates of Deposit shall be filed with the Division not less than thirty (30) days in advance of expiration of existing Bonds, Irrevocable Letters of Credit, or Certificates of Deposit.
